The U.S. Court of Appeals has thrown out three sexual abuse charges against puppeteer Kevin Clash, 53, the former voice of Elmo.
In 2012, Clash was accused of abusing multiple men more than 10 years earlier. The allegations forced Clash to resign from Sesame Street.
“The case was dismissed because of the statute of limitations. There is no ruling on the merits,” says the plaintiffs’ attorney Jeff Herman. “The case against Clash on behalf of Sheldon Stephens is still pending.”
Stephens, who is Clash’s first accuser, claims Clash abused him at 16. Stephens later recanted and said the relationship was consensual. But once additional accusations against Clash surfaced, Stephens filed suit in Pennsylvania.
In an unrelated case, Stephens has been sentenced to three months in prison for stealing educator pension checks.
